Following the decision of the D.C. Circuit Court of Appeals to stay the effectiveness of the EPA’s Cross-State Air Pollution Rule (CSAPR), Bernstein Research examined the motions to stay CSAPR presented by petitioners before the court to determine if any of the legal arguments advanced there could also be effective in securing a stay or remand of the EPA’s Mercury and Air Toxics Standards (MATS).
